1. Introduction

Welcome to SPARKi (the "App"), an educational mobile application designed to provide engaging, age-appropriate learning experiences for children from infancy to adolescence. By downloading, accessing, or using the App, you (the "User," "Parent," or "Guardian") agree to the following Terms of Service (the "Agreement"). If you do not agree to these terms, please do not use the App.

2. Definitions

2.1 User: Any individual who uses the App, including parents, guardians, and children.
2.2 Child: An individual under the age of 18, who accesses the App with parental or guardian consent.
2.3 Parent/Guardian: A responsible adult who has legal authority over a child and provides consent to use the App.

3. Eligibility

6. User Responsibilities

6.1 Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.
6.2 Appropriate Use: You agree to use the App in a manner consistent with its educational purpose and in compliance with applicable laws. You will not upload or share content that is unlawful, abusive, harmful, or offensive.
6.3 Inappropriate Content: SPARKi (M/s Skyiris Infotech Media Private Limited) has a strict policy against abusive, discriminatory, harmful, or offensive content. If any inappropriate content is found, it may result in immediate suspension or termination of the user's account.

 

7. Payments and Subscriptions

7.1 Pricing: Our App may offer premium features such as advanced learning modules, or subscriptions. The pricing for these features is clearly stated in the App.
7.2 Subscription Term: Subscription periods are typically monthly or yearly. If you choose a subscription, it will automatically renew unless you cancel it at least 36 hours before the end of the current term.
7.3 Payment Methods: Payments for subscription fees and in-app purchases are processed via [Payment Processor Name] and are subject to their respective terms and conditions.

8.3 Prohibited Uses: You are prohibited from using any part of the App’s content for commercial purposes unless explicitly authorized by SPARKi.

 

9. Termination

9.1 By User: You may terminate your account at any time by following the App's account deletion process.
9.2 By SPARKi: We reserve the right to suspend or terminate your access to the App if you violate these Terms of Service, engage in fraudulent or harmful behavior, or violate applicable laws.
9.3 Effect of Termination: Upon termination, all rights granted to you under this Agreement will immediately cease, and you must stop using the App.

 

10. App Limitation

10.1 No Warranty: The App is provided “as is” and “as available.” We do not warrant that the App will meet your expectations or be free from errors, interruptions, or defects.
10.2 Limitation of Liability: To the fullest extent permitted by law, SPARKi will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App, even if we have been advised of the possibility of such damages.
10.3 Force Majeure: We are not liable for any delay or failure in performance due to causes beyond our reasonable control, including technical failures, force majeure events, or legal prohibitions.

However, we make no representations or warranties, express or implied, about the accuracy, reliability, suitability, or availability of any information, graphics, educational materials, quizzes, articles, or any other content found on the App.

19. Dispute Resolution

19.1 Governing Law: This Agreement will be governed by and construed in accordance with the laws of Jagadhri.
19.2 Arbitration: Any disputes arising out of or in connection with this Agreement will be resolved through binding arbitration conducted in Jagadhri.
19.3 Class Action Waiver: By agreeing to these Terms, you waive the right to participate in any class action or representative lawsuit.

 

20. Changes to the Terms

We may update these Terms of Service from time to time. Users will be notified of significant changes, and continued use of the App will be deemed as acceptance of the revised terms.
